Terms of Sale

These Terms of Sale apply to all purchases of original artwork, prints, and related products from Sam Tyson Artist. By making a purchase, you agree to the following:

  1. Purchase & Ownership

    When you purchase an original painting, you acquire ownership of the physical artwork only.

    You are free to display, gift, loan, or resell the physical painting.

    This does not include copyright or reproduction rights, which remain with the artist.

  2. Copyright & Intellectual Property

    All rights, including copyright, moral rights, and reproduction rights, remain the exclusive property of the artist.

    This means you may not copy, reproduce, adapt, publish, license, or create derivative works from the artwork without the artist’s prior written consent.

    Any transfer of copyright must be set out in a separate written and signed agreement.

  3. Prints & Reproductions

    Limited-edition prints, greeting cards, or other reproductions of an artwork may be made and sold by the artist, even if the original painting has been sold.

    Buyers of the original painting do not have any claim over print sales or reproduction rights.

  4. Pricing & Payment

    All prices are shown in New Zealand dollars (NZD) unless otherwise stated.

    Payment must be received in full before artwork is shipped or collected.

    The artist reserves the right to change prices at any time.

  5. Shipping & Delivery

    Artworks are packaged with care to ensure safe delivery.

    Shipping costs and delivery times will be confirmed at checkout or in direct communication.

    International buyers are responsible for any customs duties, import taxes, or additional fees.

  6. Returns & Refunds

    All sales of original artwork are final. Returns or exchanges are not accepted unless the item is damaged in transit.

    If your artwork arrives damaged, please contact me within 7 days with photos of the damage so we can resolve it.

  7. Resale

    You may resell the original artwork, but you must not market it in a way that suggests you created it.

    The artist always retains the right to be identified as the creator of the work.

  8. Governing Law

    These Terms of Sale are governed by the laws of New Zealand.

    Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
